New Hampshire Insurance Department Issues Bulletin Addressing Fraudulent Producer Practices in Insurance Enrollments 

CONCORD, NH (June 5, 2025) – The New Hampshire Insurance Department (NHID) has issued a new bulletin in response to a rise in consumer complaints concerning insurance enrollments misrepresented by insurance producers. The Department has found multiple instances where the producer listed as the “producer of record” on an insurance application had no actual contact with the consumer and played no role in the sale of the policy.

 In particular, the NHID has identified improper use of the National Producer Number (NPN) override function on Enhanced Direct Enrollment (EDE) platforms. These non-governmental platforms allow enrollment in Affordable Care Act Marketplace plans. The NPN override function has been used to submit applications under the NPN of a different producer—one who is appointed with the insurer—despite not having any interaction with the consumer. This practice violates New Hampshire law.

 “Let it be clearly understood: this conduct, whether due to negligence or deception, betrays the trust that consumers place in the insurance system,” said Insurance Commissioner DJ Bettencourt. “Falsely claiming to represent a consumer or misusing another producer’s credentials is not just unethical, it’s unlawful. This behavior erodes confidence in the marketplace and unfairly disadvantages those who follow the rules.”

 Under RSA 402-J:12, I(h), a producer who falsely designates themselves as the producer of record, or who misuses the NPN override function, may face serious administrative penalties. These include fines, license suspension, or license revocation.

 “This bulletin serves as a clear reminder that ethical standards are not optional, they are essential to protecting consumers and maintaining a level playing field for all licensed producers,” said Deputy Insurance Commissioner Keith Nyhan. “The NHID is committed to holding violators accountable and ensuring that Granite Staters can trust the professionals who help them navigate their insurance choices.”
